Why Can't You Simply Build a Factory or House on Agricultural Land in Malaysia, Especially in Selangor?


Many landowners have a common misconception:


> "The land belongs to me, so I can build whatever I want."


In reality, that is not how the law works in Malaysia.


While you own the land, the use of the land is regulated by law.


## 1. Every Land Has a Designated Land Use Category


Under Section 52 of the National Land Code (Kanun Tanah Negara), land is generally classified into three main categories:


1. Agriculture

2. Building

3. Industry


Every land title specifies:


* Category of Land Use

* Express Condition


The registered proprietor must use the land according to these conditions. Any use that contradicts them may constitute a breach of the land conditions.


2. Agricultural Land Is Intended for Agricultural Purposes


If your land title states:


Category: Agriculture


It is generally intended for activities such as:


✅ Crop cultivation


✅ Fruit orchards


✅ Oil palm plantations


✅ Rubber plantations


✅ Livestock farming (subject to approval by the relevant state authorities)


It is not intended for:


❌ Factories


❌ Warehouses


❌ Shopping malls


❌ Commercial buildings


These developments fall under Industrial or Building land use and may require a change in land category or land conditions before they can be lawfully developed.


3. Why Can't You Build a Factory Just Because Factories Are Nearby?


A common question is:


> "Factories are already next to my land. Why can't I build one too?"


The answer is simple.


Land Use Category is not the same as Town Planning.


Even if the surrounding area has industrial developments, your agricultural land does not automatically become industrial land.


Unless the proper approvals are obtained, including where applicable:


* Land Conversion

* Variation of Express Conditions


the construction of a factory would generally not be permitted.


4. Why Can't You Simply Build Houses on Agricultural Land?


This is another common misunderstanding.


Many people believe agricultural land can be freely developed into residential housing.


Generally, agricultural land may allow structures directly related to agricultural activities, such as:


* Farmhouses

* Agricultural storage buildings

* Fertilizer stores

* Workers' quarters (subject to approval)

* Poultry houses

* Cattle sheds


However, developments such as:


❌ Housing estates


❌ Terrace houses


❌ Apartments


❌ Semi-detached houses


are residential developments that require compliance with residential land use, planning approvals, and building regulations. The permitted building types and scale are also subject to state land laws, local planning policies, and building approval requirements.


5. Why Does the Government Restrict Land Use?


Many landowners ask:


> "Why should the government regulate how I use my own land?"


There are several important reasons.


① Food Security


If agricultural land were freely converted into factories or housing, the country's long-term food production capacity would be seriously affected.


Agricultural land is therefore protected to safeguard food security.


② Proper Town Planning


Industrial developments require infrastructure such as:


* Heavy-duty roads

* Drainage systems

* Sewerage facilities

* High-capacity electricity supply

* Fire protection infrastructure


Agricultural areas are generally not designed for these requirements.


③ Environmental Protection


Industrial activities may generate:


* Wastewater

* Air emissions

* Noise pollution


Proper zoning helps minimize adverse impacts on farming communities and residential areas.


④ Public Safety


Industrial developments must comply with various statutory requirements, including:


* Fire safety

* Environmental assessments

* Road standards

* Safety buffer zones


Factories cannot simply be constructed without these approvals.


⑤ Fairness in Land Value


Industrial land is usually worth significantly more than agricultural land.


If landowners could develop factories without paying the applicable Conversion Premium, it would create an unfair system.


For this reason, state governments may impose a land conversion premium when approving changes in land use.


6. What Happens If You Breach the Land Conditions?


If a landowner uses the land contrary to its registered land category or express conditions, the State Authority may take enforcement action, including:


* Issuing notices

* Requiring rectification

* Refusing related applications

* In serious cases, initiating forfeiture proceedings in accordance with the law


7. What If You Intend to Build a Factory?


The proper process generally involves:


1. Confirming whether the Local Plan permits industrial development.

2. Applying to the State Land Office for a change in land category or variation of land conditions (for example, under Sections 124 and 124A of the National Land Code, where applicable).

3. Obtaining technical evaluations from the relevant authorities.

4. Paying the applicable Conversion Premium.

5. Securing planning permission, building plan approval, and all other statutory approvals.

6. Commencing construction only after all approvals have been granted.


Conclusion


Owning land does not mean you have unrestricted rights to develop it.


An agricultural parcel does not automatically become industrial land simply because:


* it is located near factories,

* it has strong development potential, or

* the owner wishes to develop it.


What ultimately determines how land may be used are:


* The Land Category stated on the title

* The Express Conditions

* The Local Plan

* Approval from the State Authority

* The National Land Code and the relevant State Land Rules

很多地主都有一个误解:

「土地是我的,我喜欢建什么就建什么。」

事实上,在马来西亚,并不是这样。

土地属于你,但土地的使用权受到法律限制。


第一、土地有不同用途(Land Use Category)

根据《国家土地法典》第52条(Section 52 National Land Code)规定,政府把土地分成三大类别:

1. Agriculture(农业)

2. Building(建筑)

3. Industry(工业)


每一块土地,在地契(Title)上都会注明:

• Category of Land Use(土地用途)

• Express Condition(明确用途条件)

地主必须按照这些用途使用土地,否则属于违反土地条件。


第二、农业地只能作农业用途

如果你的地契写着:

Category : Agriculture

那么法律要求:

✅ 种植农作物

✅ 果园

✅ 油棕园

✅ 橡胶园

✅ 畜牧业(视州政府批准)

而不是:

❌ 建工厂

❌ 建仓库

❌ 开购物中心

❌ 建商业楼

因为这些已经属于:

Industrial Use(工业用途)

Building Use(建筑用途)

已经违反土地用途。


第三、为什么不能随便建工厂?

很多人问:

工厂就在旁边,我这块农业地为什么不能建?

原因很简单。

因为:

土地用途(Land Category)

Town Planning(城市规划)

即使:

✔ 周围都是工厂

你的土地如果没有:

• 转换土地用途(Conversion)

• 更改土地条件(Variation of Express Condition)

一样不能合法建工厂。


第四、为什么农业地不能随便盖房子?

这是最常见的问题。

很多人认为:

农业地可以盖很多房子。

其实不对。

一般而言:

农业地允许建设与农业用途直接相关的建筑,例如:

• 农舍

• 农具仓库

• 肥料储藏室

• 员工宿舍(经批准)

• 鸡舍

• 牛舍

但如果是:

❌ 大型住宅区

❌ 排屋

❌ 公寓

❌ 半独立洋房

这些属于住宅开发,需要符合住宅用途及规划审批,并不能因为土地是自己的就直接兴建。具体允许的建筑类型及规模,还会受到州土地条例、地方政府规划和建筑审批制度约束。


第五、为什么政府要限制?

很多地主觉得:

政府为什么要管?

其实有五个主要原因。

① 保障粮食安全(Food Security)

如果全国农业地都改建工厂:

以后粮食从哪里来?

所以农业地必须受到保护。

② 城市规划(Town Planning)

工厂需要:

• 重型道路

• 排水系统

• 污水处理

• 电力容量

• 消防设施

农业地区通常没有这些基础设施。

③ 环境保护

工业:

• 废水

• 废气

• 噪音

不能影响农业及居民。

因此需要分区管理。

④ 公共安全

工业区必须符合:

• 消防要求

• 环境评估

• 道路标准

• 安全距离

不能随便建设。

⑤ 土地价值公平

工业土地通常价值远高于农业土地。

如果不用缴付转换用途溢价(Conversion Premium),就能直接建厂,将造成制度不公平。因此,法律规定申请转换用途时,州政府可征收土地用途转换溢价。


第六、违反会怎样?

如果地主违反土地用途条件:

州政府可以:

• 发出通知

• 要求整改

• 拒绝相关申请

• 在严重情况下,依法采取土地没收(Forfeiture)程序

因为违反了土地的用途条件。


第七、如果真的想建工厂怎么办?

正确程序通常包括:

1. 确认地方规划(Local Plan)是否允许工业发展。

2. 向州土地局申请更改土地类别或土地条件(例如依据《国家土地法典》第124及124A条)。

3. 由相关部门评估。

4. 缴付土地转换溢价(Conversion Premium)。

5. 获得批准后,再申请规划许可、建筑图测及其他法定批准。

6. 全部批准完成后,才能合法兴建工厂。


总的来说,

土地属于地主,但土地用途属于法律管理。

一块农业地,并不会因为位置好、附近有工厂,或地主有发展意愿,就自动变成工业地。

真正决定土地能建什么的,不是地主,而是:

• 地契上的土地类别(Land Category)

• 明确用途条件(Express Condition)

• 地方规划(Local Plan)

• 州政府批准

• 《国家土地法典》及相关州土地条例


这也是为什么,专业的土地调查(Land Due Diligence 或 land investigation)在任何土地投资或开发之前都至关重要。只有充分了解土地的法律身份、规划限制和审批路径,才能降低投资风险,避免因违规开发而蒙受重大损失。
